ENTITY RESPONSIBLE FOR THE PROTECTION OF PERSONAL DATA

LEXLINKER, S.A.P.I. DE C.V. (hereinafter “LEXLINKER”), with an address located at __________________________________________________, is responsible for the processing of your personal data that are provided by the individuals to whom such data correspond (hereinafter the Holder), as well as for their use and protection. In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”). “LEXLINKER” has all the appropriate physical, technical, and administrative security measures to protect your personal data and prevent unauthorized third parties from accessing them.

PERSONAL DATA


The processing of the Holder's personal data that has been made available to “LEXLINKER” in any form or circumstance may be carried out in accordance with these terms and conditions, so from this moment it is understood that the Holder gives his consent for such processing. Personal Data and Sensitive Personal Data are understood as follows:

Personal Data: Any information concerning an identified or identifiable individual, including but not limited to: (i) full name, (ii) age or date of birth, (iii) place of birth, (iv) activity, profession, occupation or trade, (v) home address, (vi) telephone number, (vii) email, among others.

Sensitive Personal Data: Those personal data that affect the most intimate sphere of their owner, or whose improper use may lead to discrimination or entail a serious risk for them. In particular, Sensitive Personal Data are considered those that can reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions, sexual preference, among others.


PERSONAL DATA THAT ARE PROCESSED

LEXLINKER may obtain personal data directly provided by you, either in person or through electronic means or correspondence. In some cases, LEXLINKER may also obtain such data indirectly through third parties or other sources.

The personal data that LEXLINKER may obtain and use include the following: your full name, phone number, email address, home address, place of work, photograph, signature, voter ID data, passport and visa data, nationality, immigration status, RFC, CURP, job position, account data, marital status, credit history, union affiliation, and fiscal and corporate information.

Information collected from visitors; Like other website operators, LEXLINKER collects non-personal identification information that browsers and web servers typically make available through the use of common information collection tools, such as cookies. This non-personal identification information includes the visitor’s browser type, language preference, referring site, additional websites requested, and the date and time of each visitor request. We also collect potentially personally identifying information, such as Internet Protocol (IP) addresses. The purpose of LEXLINKER in collecting non-personal User information is to better understand how our visitors use our website to improve their user experience and to post more relevant ads or promotional offers on our site or on third-party sites based on that information.

Becoming a User: You can visit our website without creating an account, but you will not have full access to our service. Visitors who wish to use the service must create an account, thus becoming a User. To create an account, Users must provide LEXLINKER with personal contact information, such as name and email address, or log in to LEXLINKER through the LinkedIn authentication service.

Location-based data: LEXLINKER also makes use of location-based data for our website. If you allow these services, we will ask you to enter your general location. We will use this information to provide you with services or to offer you more relevant ads or promotional offers, not to personally identify you.

Confidentiality and service offerings; To access the website, service posters may post certain information through an online service form or by speaking with a LEXLINKER employee. This information may include, among other things, a description of the business and legal service questions and inquiries to be performed. This posted service will be viewed by those legal Advisors who have access to view the posted proposals and may be viewed by LEXLINKER employees to ensure quality control and provide technical support. Privately posted service proposals will only be visible to a job poster and to the legal Advisors specified by the job poster, as well as to LEXLINKER employees. Therefore, no service proposal is confidential. Please do not share sensitive or confidential information through the website.

The Holder of the Information acknowledges and agrees that, due to their relationship with LEXLINKER, they have not provided, nor will they have to provide “sensitive personal data”, that is, those intimate personal data or whose due or undue realization may give rise to discrimination or entail a serious risk for them. In the event that the Holder of the Information provides data of the so-called sensitive type, they must agree to provide them in advance and will leave LEXLINKER free of any complaint or respective claim.


PURPOSE OF DATA PROCESSING


Commercial Purpose.- This information may be used, by way of example but not limited to: offering products and services, either physically, by telephone, electronically, or by any other technology or means available to LEXLINKER; informing you of new products or services that may be of interest in relation to the contracted service; automatically processing billed charges for your convenience; issuing purchase orders or work requests, as appropriate; and/or any other action that is necessary to comply with the interests of LEXLINKER regarding the agreement reached with the Holder of the Information.

Employment Purpose.- This information may be used, by way of example but not limited to: evaluating as a possible candidate to fill a vacant position; if applicable, drafting the corresponding Service Provision Contract and/or Individual Employment Contract; providing references if another person or company requests them about candidates.

Security Purpose in Access to Facilities.- This information may be used, by way of example but not limited to: supporting, recording, and/or controlling the registration of people who access or visit LEXLINKER facilities; complying with security guidelines established in LEXLINKER's internal policies. In relation to the information requested for entry to LEXLINKER facilities, information such as full name, signature, official identification, and information on electronic equipment to be brought into LEXLINKER facilities may be requested.

To provide the services you request: LEXLINKER uses the user's personal information to perform and provide the services requested. For example, to allow job posters to select the best legal Advisor for their needs, facilitate communication between legal Advisors and job posters, and simplify job billing. We use location-based data to enable consultant users to apply for jobs in their local area and jurisdiction. We also use the user's personal information to fill out online profiles.

To improve our service. LEXLINKER may use aggregated non-personally identifiable information collected from our web server to operate, improve, and optimize our website and service.


RIGHTS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA


The information delivered to “LEXLINKER” will be duly safeguarded, preserved, and protected, with adequate administrative, technical, and physical security measures to prevent its loss, misuse, alteration, unauthorized access, and theft. Only those persons authorized by “LEXLINKER”, whether employees, service providers, or business partners, who have committed to keeping the information under strict confidentiality and security, will have access to the information. To this end, employees have been trained in its handling, signing a confidentiality agreement with “LEXLINKER”, and suppliers and business partners have included a clause in agreements and contracts where the confidentiality of the information is agreed upon.


TRANSFER OF PERSONAL DATA

In the event that the personal data safeguarded by “LEXLINKER” are required by an authority of any kind, either by legal process, to respond to any claim or legal actions due to the fulfillment of the legal relationship established between the Holder and “LEXLINKER”, or to protect the rights of “LEXLINKER” or its customers and the public; this data will be made available to the authority in strict compliance with the Law.

This transfer will be carried out taking reasonable measures, necessary and within the reach of “LEXLINKER” to protect personal data against damage, loss, alteration, destruction, or unauthorized use, access, or treatment. Access to this information is limited to people who need to know it to fulfill the purpose of their work.

Your personal data can be transferred and/or processed inside and outside the country, by third parties that have been contracted by “LEXLINKER” and/or any of its subsidiaries and/or affiliates to perform certain tasks related to commercial activities and promotion of its products and/or services on its behalf and representation. In this sense, your information may be shared with Mexican and foreign third parties and members of our group, to provide necessary services for proper operation. EXCEPTIONS TO THE CONSENT FOR THE PROCESSING AND TRANSFER OF PERSONAL DATA

Additionally, and in accordance with the provisions of Articles 10, 37, and others related to the Law and its Regulation, “LEXLINKER” will be exempted from the obligations regarding consent for the Processing and Transfer of your Data when it is provided for in a Law and/or the data appear in sources of public access;

In case you have requested access to your personal data, “LEXLINKER” will provide you with a simple copy of the data it has available, this copy can be sent through electronic means or traditional correspondence within the period described in the previous paragraph.
